Javier Robalino


Javier Robalino Orellana is a partner at FERRERE in Ecuador and a member of the firm’s global executive committee (2015). He also co-chairs the arbitration practice and acts as managing partner for Ecuador.

He earned an LL.M degree from Duke University School of Law (2006, cum laude) and obtained an S.J.D. from Universidad Católica de Quito (1990-1995). In addition, he has engaged in studies at the ILO (International Labour Organization); Program on Social Security Modernization in Turin, Italy, (2004); Harvard University, Program of Instruction for Lawyers (1998); University of California, San Diego, Diploma in Political Science (1995); and University of Texas in Dallas, Diploma in Comparative Law (1994).

Robalino represents many multinationals in various local and international commercial and investment disputes. He has participated in many cases under CIADI, CNUDMI, CIAC, CCI, and CAM-Santiago rules, among others. Robalino also participates in international public law cases under WTO, Andean Community of Nations (CAN), and the Inter-American Convention on Human Rights rules, among others.

In the academic field, Robalino is a professor of administrative law at Instituto de Derecho y Empresa INIDEM-Business Law School of Central America (2011). He is also professor of administrative and international law at Universidad San Francisco de Quito (USFQ) (1999) and Chair of the Graduate Program (2003).

Robalino has been a visiting professor in various graduate programs including: the ALArb - Cámara de Comercio de Bogotá Arbitration Program (2013 ), Energy Graduate Program at Universidad Carlos III in Madrid, Administrative Law at Universidad Católica Santiago de Guayaquil (2007-2013). Since 2015, he has been a member of the board at ASIER - Asociación Iberoamericana de Estudios de Regulación. Also, since 2016, he has been part of the Advisory Board of the Southwestern Legal Foundation. He is also a member of the ICC Committee in Ecuador. As of the fall 2016 he has taught in the LL.M program at University of Miami.

Javier Robalino recently published, with Spanish professor Jaime Rodríguez-Arana Muñoz, the book “Global Administrative Law, towards a Lex Administrativa” (Pub. Cameron May, London, 2011). Robalino has written numerous publications on international public law, globalization of contracts, international investment law, and enforcement of international awards.

Chambers recognizes him in four practice areas in 2016. He is described as "responsive, smart and helpful" and a “strategic thinker." Robalino "looks at the big picture with a strategic perspective,” according to the publication. In addition, Robalino is listed in the renowned commercial arbitration guide, Expertguides and Who’s Who Legal in both arbitration and corporate tax.

He has also participated in collective publications such as El arbitraje Comercial Internacional, Estudio de la Convención de Nueva York con motivo de su 50mo aniversario (Abeledo Perrot, 2008, led by Guido S. Tawil and Eduardo Zuleta) and Enforcement of Arbitral Awards Against Sovereigns (Juris Publishings, 2009, led by Doak R. Bishop). He is currently leading a collective publication by Springer on PPPs, on public and global comparative law. He continues to research global administrative law and international arbitration subjects.

In 2011 Robalino was recognized by Global Arbitration Review “45 under 45” as one of the leading practitioners in international arbitration. He is former chair of the ALArb State Relations Committee, former Director of the Ibero-American Forum on Administrative Law (2007-2013), former representative of Club Español de Arbitraje CEA, and former Director of the Chamber of Industries (2003-2005).

He often participates in diverse academic activities with a variety of international organizations and universities such as the IBA, IFA, and ABA. In 2015, at the annual meeting of the IBA, Robalino made a presentation on the integration of systems of public law through the influence of international law, and its influence on local administrative law systems, including through international soft law.

He is an arbitrator and/or has been appointed or nominated as arbitrator of the International Centre for Dispute Resolution (ICDR), PCA, CIAC, CAM Santiago, International Arbitration and Mediation Center and is an arbitrator for the Centro de Arbitraje de la Cámara de Comercio. He has also acted as expert witness in matters of public law under ICC and UNCITRAL rules.

Robalino has also been a foreign associate of King & Spalding LLP, in Houston, Texas (2006-2007), Professor of Administrative Law at Universidad Católica de Quito (September 1996-2002), Member of the Regulatory Commission of the Office of the President of the Republic of Ecuador (2002-2003), Country Head - Legal Division at Arthur Andersen LL.P in Ecuador (1996-1998), Executive Assistant and head of the Office of the President of the Supreme Court and coordinator for Judicial Reform Project (1995-1996), Summer Associate at Cantey & Hanger, Fort Worth, Texas (1994), partner at Paz Horowitz Robalino Garcés Abogados S.A. (2011-2015) and Pérez Bustamante y Ponce (2007-2011).
